Applicants are eligible to apply for this visa on the basis of their family relationship to a sponsor in Australia. The family should be essentially as de-facto or non-de-facto spouses, fiancés, interdependent partners, aged dependent relatives, last remaining relatives, carer and parents who meet the "balance of family test." These applicants are exempt from the skills test and English language ability that are normally required for other visas.
De facto or Non-de facto Spouse and Interdependent Partners The applicants may lodge their applications onshore or offshore. If onshore, applicants must be in Australia at time of application and have not condition prventing them from applying onshore. To apply for this visa the applicant must meet the following criteria: - Be married or in de-facto relationship or interdependent relationship with an Australian citizen, permanent resident or Eligibile New Zealand citizen and be sponsored or nominated and should be sponsored by spouse or interdependent partner.
- If the applicant is applying based on de-facto relationship has to show The Department of Immigration and Citizenship that the relationship have existed for a minimum period of 12 months.
- Should be able to prove that the relationship with sponsor is genuine and continuing.
Fiancée The applicant must lodge application offshore. To apply for this visa the applicant must meet the following criteria: Be engaged to be married to an Australian citizen, permanent residence, or eligible New Zealand citizen and be sponsored by his/her fiancée. - Be able to prove that there is genuine intention to marry his /her fiancée and live together in a spousal relationship within 9 months of arrival in Australia.
Aged Dependent Relatives The applicants may lodge application onshore or offshore. To apply for this visa the applicant must meet the following criteria: - Should be single, widowed or divorced aged person who is dependent on the sponsor living in Australia.
- Have been dependent on the sponsor for at least 3 years before lodging the application.
- Requires assurance of support in most cases.
Remaining Relatives This visa enables a close family relative who would otherwise be left on his/her own overseas, to migrate to live with other family members already living in Australia. The applicants may lodge application onshore or offshore. To apply for this visa the applicant must meet the following criteria, - Should be brother, sister, or child or step-child of an Australian citizen, permanent resident or eligible New Zealand citizen.
- Should be sponsored by the relative leaving in Australia.
- Requires assurance of support.
Parents To apply for this visa the applicant must meet the following criteria, - Must be a parent of a child who is an Australian citizen, permanent resident or eligible New Zealand citizen.
- Sponsoring child must have stayed in Australia for a minimum period of 2 years.
- Application can be filed onshore or offshore depending on the age of applicant.
Carer The applicants may lodge application onshore or offshore. This visa enables an applicant who is willing and able to give substantial continuing assistance to an Australian relative or member of his/her family who has a medical condition that is causing physical, intellectual or sensory impairment of their ability to attend to the practical aspects of daily life. To apply for this visa the applicant must meet the following criteria, - The need for assistance must be likely to continue for at least two years.
- Be a relative or member of the family of the Australian citizen, Australian permanent resident, or eligible New Zealand citizen requiring the care.
- Should be sponsored by the relative leaving in Australia.
- Requires assurance of support.
